اللّسانيات القانونية : تأسيس نظري ودراسة تطبيقية نموذج الأفعال الإنجازية في نصوص ميثاق السلم والمصالحة الوطنية (الجزائر 2006م)

Abstract

تندرج هذه الدراسة تحديدا ضمن مباحث محور الممارسات اللسانية التداولية في الخطابات( نموذج القانون الجزائري). والغاية الخروج باللسانيات التحليلية من دائرة ضيقة في ذاتها إلى فضاء أكثر انفتاحا على الخطابات الإنشائية، والانتقال من المستوى النظري العام إلى المستوى التطبيقي الخاص بالميادين المعرفية. والخطاب القانوني باعتباره بنية لغوية دالة دقيقة محكمة النسيج تتسم بالعموم والشمول والتجريد، جدير بالتحليل اللساني في ألفاظ الأفعال الكلامية الإنجازية التي تتصدر المواد القانونية بوضوح، ولا شك أن من يتولى الصياغة القانونية والتنفيذ والقضاء يتمتع بقدر وافر من الثقافة اللغوية والبشرية والاجتماعية والسياسية. This research falls specifically within the topics of the axis of pragmatic linguistic practices in discourses (Algerian law as a model). The aim is to bring analytic linguistics out of the narrow circle in itself into a space more open to structural discourses, moving from the general theoretical level to the specific applied level between fields of knowledge. The legal discourse as a linguistic structure with functional accuracy and good structure, characterized by generality, comprehensiveness and abstraction, deserves linguistic analysis with the words of the verbs of achievement that clearly top the legal materials. There is no doubt that those in charge of legal drafting, implementation and the judiciary have a wealth of linguistic, humanitarian, social and political culture.
