الرقمنة في المكتبات الجامعية وإشكالية الاستخدام المشروع للمصنفات الأدبية

Abstract

تواجه المكتبات الجامعية صعوبات متعددة حول أهدافها المتعلقة بالتحول الرقمي، التي جاءت استجابة إلى التوجه الحكومي الرامي إلى الاندماج في العالم الرقمي. ولعل ابرز الصعوبات التي توجهها المكتبة هي الحقوق والالتزامات المتعلقة بالوثائق التي لا تزال مشمولة بالحماية و المراد رقمنتها، لما في الأمر من مساس بمصلحة أصحابها و بقواعد الملكية الفكرية. وعليه فقد جاءت الدراسة من اجل تسليط الضوء على كيفية رقمنة الأرصدة الوثائقية ضمن إطار الاستخدام المشروع مع توضيح الصور التي تعتبر انتهاكات من وجهة نظر القانون، وقد اعتمدت الدراسة على المنهج الوصفي، وقد توصلت الدراسة إلى أن مسؤولية ضمان الاستخدام المشروع تقع على عاتق المكتبي عن طريق التعاقد بشأن ترخيص بالرقمنة، كما أن التعاقد لوحده غير كافي بل لابد على الهيئات الوصية من إصدار نصوص قانونية تسمح بتسيير عملية الرقمنة بشكل قانوني حفاظا على حقوق أصحاب المصنفات الأدبية. University libraries face many difficulties regarding their goals related to digital transformation, which came in response to the government’s orientation aimed at integrating into the digital world. Perhaps the most prominent difficulties faced by the library are the rights and obligations related to the documents that are still protected and to be digitized, because of the prejudice to the interests of their owners and intellectual property rules. Accordingly, the study came in order to shed light on how to digitize documentary balances within the framework of legitimate use, while clarifying the images that are considered violations from the point of view of the law. Contracting for a license to digitize, and contracting alone is not sufficient, but the custodian bodies must issue legal texts that allow the digitization process to be conducted legally in order to preserve the rights of owners of literary works.
