التراث الثقافي: بين ضرورات الرقمنة وغياب التشريع

Abstract

اهتم المشرع الجزائري بالتراث الثقافي الوطني، وتجلى اهتمامه بإصدار القانون رقم 98-04 المتعلق بحماية التراث الثقافي سنة 1998، حيث تضمن قواعد عامة تحدد الإطار القانوني لتثمين والمحافظة على الموروث الثقافي، إلا أنه مع التطور التكنولوجي ظهرت ما يسمى برقمنة التراث الثقافي، ما أ سفر عن وجود فراغ تشريعي في استحداث الحماية الرقمية، حيث أضحت القواعد العامة لهذا القانون عاجزة عن مسايرة التغيرات السريعة في تقنيات المعلومات، وانتقالها من المجال التقليدي إلى المجال الرقمي، الأمر الذي يدعو المشرع إلى ضرورة ضبط ومراجعة قانون حماية التراث الثقافي، واستحداث آليات رقمية لتعزيز حمايته وتوثيقه إلكترونيا، وحفظه من الاندثار والزوال.
